Overview

Reporting to ArchCare’s SVP, Compliance, the Corporate Director of Compliance provides support and analysis to ArchCare’s enterprise-wide Compliance program, including ArchCare’s nursing homes, health plans, home care agencies, and assisted living program. The Director will coordinate the 1) development of an annual compliance risk assessment for each of the programs and 2) the implementation of the annual compliance audit work plan for each of the divisions, which will be based on the results of the risk assessments. The Director is also responsible for ensuring that all compliance issues, reports, complaints, and questions with respect to the ArchCare entities are properly addressed as they arise, and that appropriate compliance assurance reviews, audits, or other follow-up are conducted with respect to the issues arising from compliance concerns. The Director will also coordinate ArchCare’s response to audit requests from government entities. Finally the Director will review for legal form and for regulatory compliance, provider contracts and other high risk for the ArchCare system.

Responsibilities

Coordinate Annual Compliance Risk Assessment Process and Development of Compliance Work

  • Analyze new regulatory requirements, emerging regulatory and enforcement risk areas, past internal and external audit results, and other relevant factors for each ArchCare Entity
  • Create risk assessment methodology for each ArchCare Entity, arraying important risks and developing a risk ranking methodology
  • Meet with teams of stakeholders at each ArchCare Entity Communicate to present the risk assessment methodology and solicit their opinions on the relative rankings of risks as well as whether other risks should be included
  • Using the results of the risk assessment, create a compliance audit work plan for the enterprise, including a component for each Entity.
  • Summarize and present the results of the risk assessment for each Entity in a concise and meaningful format for review by stakeholders and review and approval by the Executive Compliance Steering Committee, and governing bodies members
  • Maintain consistent and complete business records of risk assessment and work plan process

 

Coordinate Responses to Compliance Issues

  • Coordinate with the Compliance Officers of each of the ArchCare Entities to ensure that all compliance issues, reports, complaints, and questions with respect to the ArchCare Entities are properly addressed as they arise, and that appropriate compliance assurance reviews, audits or other follow-up are conducted with respect to those issues. Note: a vast majority of the follow up will be performed by employees within the Entity that is the source of the complaint. This position will be mainly coordinating and reviewing the responses for appropriateness and completeness.
  • Maintain record of follow up to all issues on online platform.
  • Summarize status and investigation outcome of all reported compliance issues to internal compliance committees and to ArchCare’s governing bodies.
  • Coordinate the presentation of results of compliance investigations and monitoring activities by ArchCare Entities for compliance meetings and Board meetings, reviewing and improving format and content.

 

Perform Legal and Compliance Review of Provider Contracts and Other High Risk Contracts

  • The Director will review for legal form and for regulatory compliance, provider contracts for the ArchCare system as well as other contracts that require special analysis in the health care sector, such as coding and consulting contracts.

 

Provide advice on healthcare laws and regulations

  • The Director will provide counsel to stakeholders throughout the organization regarding the application of various state and federal health care laws, including HIPAA, Anti-Kickback, Anti Referral, and False Claims and will work with individuals and teams to craft policies and processes that minimize legal and compliance risk.

Education Required

  • Bachelor's Degree
  • Law Degree

 

License Required

  • NYS Bar Admission

 

Experience Required

  • 5 Years, 3 within healthcare

 

Skills Required

  • Strong interpersonal and communication skills
